Addendum for Microsoft Windows Home Server’s Windows Live Custom Domains service

This Addendum for Windows Home Server’s Windows Live Custom Domains service (the “Custom Domains service”) supplements the terms in our existing Microsoft Service Agreement.

Selection and use of a domain

The Custom Domains service is available to customers who have acquired properly licensed, genuine Microsoft Windows Home Server software. It is a free service that Microsoft is providing to you for your convenience. Microsoft gives you the right to use the Custom Domains service and domain name provided. We reserve all rights not granted to you.

The domain name is being provided for your personal use in connection with Microsoft Windows Home Server. Microsoft will attempt to provide you with the domain name that is your first choice, however, you acknowledge that Microsoft cannot guarantee you will obtain a desired domain name.

You cannot use the domain provided by Microsoft in connection with Activated E-Commerce Shopping Functionality. “Activated E-Commerce Shopping Functionality” means functionality that allows you to sell goods and services and conduct payment processing transactions online (e.g., online shopping carts, payment calculation and checkout systems, and credit card processing).

You are responsible for making sure that your use of the Custom Domains service and Windows Home Server’s remote access features complies with your broadband providers’ terms of service. You may need to add services from your broadband provider to use Windows Home Server’s remote access features. For example, you will need certain “ports” to be open to use these features, and some broadband providers block those ports for customers on some service plans. Also, some broadband providers’ terms of service may limit or prohibit setting up and running of “servers” on their networks by some customers on some service plans. Please contact your broadband provider if you have questions about their terms of service.

You must respect the privacy of your domain users.

Microsoft is committed to protecting our customer’s privacy. You must be committed to protecting your domain users’ privacy. Just as we do in the Microsoft Online Privacy Statement, we recommend that you tell your domain users how you will collect, use, manage, and share their personal information. Also, you must give your domain users the option of setting their communication preferences, including “opting out” of receiving non-service related messages. Finally, if you collect email addresses from your domain users, we recommend that you respect each of your domain users’ email addresses by never sending your domain users unsolicited bulk or commercial email or giving their email address to anyone that sends unsolicited bulk or commercial email.

Modifications to the Custom Domains service and this addendum

The Custom Domains service is a new service offered to you by Microsoft and may be modified or cancelled at any time. Other than the Code of Conduct below, which can be changed at any time without notice, if we change this addendum, then we will tell you at least 30 days before the change takes place. If you do not agree to these changes, then you must cancel and stop using the Custom Domains service before the change takes place. If you do not stop using the Custom Domains service, then your use of the service will continue under the changed addendum. You can stop the service by unconfiguring the domain name provided to you by Microsoft.

Code of Conduct

To ensure that everyone using the Custom Domains service has the best possible experience, we have established a Code of Conduct. We may, but have no obligation to, monitor use of the Custom Domains service to ensure compliance with these guidelines.

If you decide to make your custom domain website (e.g., http://smithfamily.homeserver.com) (“Custom Domain website”) available to others, don’t post anything you don’t want them to see.

By using the Custom Domains service, you agree to abide by our Code of Conduct. All activity using this service is also governed by this addendum and the Microsoft Service Agreement.

Violations of this Code of Conduct may result in the revocation of your Custom Domain website’s security certificate and termination of access to your Custom Domain name. Microsoft reserves the right to take such action, at its sole discretion, at will and without notice.
